28, par. 9); chi vuole una copia firmata la chiede a info@pixelair.it.

6. Sicurezza (art. 32)
- collegamenti cifrati (HTTPS);
- password conservate solo come impronta crittografica (scrypt con sale); il Responsabile non le conosce;
- gettoni d'accesso di John Deere e CNH cifrati (AES-256-GCM), cancellati quando il Titolare scollega l'account;
- accesso ai dati dentro Agronix per ruoli e permessi decisi dal Titolare;
28, par. 4).
| Sub-responsabile | Attività | Dove |

| Railway Corporation (Stati Uniti) | ospita Agronix e i dati | regione EU West, Amsterdam (Paesi Bassi) |
| Aruba S.p.A.
8. Trasferimenti fuori dall'Unione europea
I dati stanno su server nell'Unione europea.
28, par. 10).
Personal data processing agreement
1. The parties
Controller: the farm or other Customer using Agronix, with the details stated in the order, hereinafter the «Controller».
Processor: AG Eventi di Gili Alex (Pixel Air, Agronix), Via Monfalcone 49, 13100 Vercelli (VC), Italy, VAT no. IT02784630028, PEC legalmail@pec.ag-eventi.it, email info@pixelair.it, hereinafter the «Processor».
This agreement is part of the Agronix Terms and applies for their whole duration. It is concluded electronically together with the Terms, at the first sign-in of the owner of the workspace (art. 28, para. 9); anyone wanting a signed copy can ask info@pixelair.it.
2. Subject matter, nature and purpose
The Processor processes the personal data the Controller enters or produces in Agronix only to provide the Agronix functions it uses: storage, processing and display of data, calculations on drone flights and images, exports, alerts, data exchange with the services the Controller connects, technical support when the Controller requests it. The Processor does not use the data for its own purposes, does not sell or transfer them and does not profile.
3. Types of data and data subjects
| People | Data |
|---|---|
| The farm's Agronix users | name, email, role and permissions |
| Farm owner, family members, employees and collaborators | name, job title, email (optional), hourly cost, hours worked with fields and machines; who carried out the treatments in the register |
| Users of «In the cab» | the phone's GPS position every 10 seconds with speed and accuracy, chosen machine and person, start and end time; the time in each field derived from these positions |
| Contractors and suppliers | names and data the Controller enters in the register, in stock and in costs |
| People filmed by chance | aerial photos of drone flights, with position and date |
Agronix does not ask for special categories of data (art. 9) or data on convictions and offences (art. 10), and the Controller does not enter them.
4. The Controller's instructions
- The Controller's documented instructions are the Terms, this agreement and the operations the Controller's users carry out in Agronix (for example: connecting John Deere Operations Center or CNH FieldOps is the instruction to exchange with those services the data described in the privacy policy; choosing email alerts is the instruction to send them).
- The Processor processes the data otherwise only if required by Union or Italian law, and in that case informs the Controller beforehand, unless the law forbids it.
- The Processor immediately informs the Controller if, in its opinion, an instruction infringes the GDPR or other data protection rules.
- John Deere, CNH and the other services the Controller connects process the data as independent controllers, under the terms the Controller has accepted with them: they are not sub-processors of Agronix.
5. Confidentiality
Only people authorised by the Processor, bound to confidentiality, may access the data, and only when needed: support requested by the Controller, maintenance, security.
6. Security (art. 32)
- encrypted connections (HTTPS);
- passwords stored only as a cryptographic fingerprint (scrypt with salt); the Processor does not know them;
- John Deere and CNH access tokens encrypted (AES-256-GCM), deleted when the Controller disconnects the account;
- access to data within Agronix by roles and permissions decided by the Controller;
- servers in the European Union; the flight processing machines are deleted at the end of each calculation.
7. Sub-processors
The Controller gives a general written authorisation (art. 28, para. 2) to the sub-processors below. The Processor imposes on them, by contract, data protection obligations like those of this agreement and remains liable to the Controller for their performance (art. 28, para. 4).
| Sub-processor | Activity | Where |
|---|---|---|
| Railway Corporation (United States) | hosts Agronix and the data | EU West region, Amsterdam (Netherlands) |
| Scaleway SAS (France) | processing machines for drone flights | Amsterdam (Netherlands) |
| Aruba S.p.A. (Italy) | sending emails | Italy |
If the Processor wants to add or change a sub-processor, it informs the Controller's administrators by email at least 30 days in advance. The Controller may object with a reason within that period; if no solution is found, it may withdraw from the contract without penalties.
8. Transfers outside the European Union
The data are on servers in the European Union. Railway Corporation is based in the United States: any transfer is based on the adequacy decision on the EU-US Data Privacy Framework (Implementing Decision (EU) 2023/1795), in which it is listed. Other transfers only on the Controller's instructions.
9. Assistance to the Controller
- Data subjects' rights (chapter III): the Controller can view, correct, export and delete the data from Agronix; when this is not enough, the Processor helps within 10 working days of the request. If a person writes to the Processor about the Controller's data, the Processor forwards the request to the Controller without answering on the merits.
- Security, impact assessments and consultation of the supervisory authority (arts. 32-36): the Processor gives the Controller the information it has.
10. Personal data breaches
The Processor informs the Controller without undue delay after becoming aware of a personal data breach (art. 33, para. 2), and in any case within 48 hours, with the information under art. 33, para. 3, available at that time, so that the Controller can notify the supervisory authority within 72 hours.
11. Retention and end of the contract
- The «In the cab» positions are deleted automatically 12 months after the day of the work; the hours recorded in «Staff and hours» stay with the Controller's data.
- At the end of the contract (expiry without renewal or closure requested by the Controller) the Controller chooses: download the data with the Agronix exports (fields, register, hours, stock, observations, maps) or ask the Processor for a full copy in open files; then the Processor deletes the data and copies within 30 days, as in point 5 of the Terms, except those the law requires it to keep.
12. Audits
The Processor makes available to the Controller the information needed to demonstrate compliance with this agreement and allows audits, including inspections, by the Controller or by whoever it appoints (art. 28, para. 3, letter h): with at least 30 days' notice, at most once a year except in case of a breach or a request from the supervisory authority, at the Controller's expense and without access to other customers' data.
13. Everything else
For anything not written here, the Agronix Terms and the GDPR apply. If the Processor determined the purposes and means of the processing by itself, it would be considered the controller for that processing (art. 28, para. 10).
